We are requesting a change to our rear yard setback to allow for a swimming pool. Due to the COVID-19 pandemic, our family decided to have an in-ground pool built by Rocky Mountain Pools, as public pools have been closed for two years. We understand the current platted rear yard setback is 30’, an excessive amount, particularly for an in-ground pool. Per the enclosed drawing, we propose to maintain the 10’ rear yard utility easement and locate the pool 12-6”’ in from the rear property line. There are several limiting factors, the most dominate is our well. It is located 34’ from the rear property line and 30’-1” from the side yard property line. The well supplies water to our water source heat pump used for heating and cooling our passive solar home. The water is also used for our landscaping in lieu of city treated water. Our property also has 15 mature trees for strategic shading, aesthetics and wildlife. We want to minimize the impact to our trees. We have also spoken with our closest neighbors regarding pool location and have sited the pool at a mutually agreed location in our backyard. We built our home in 1984 at which time we had the well dug and most of the trees installed. It has always been our goal to build a pool someday. Precedence. There has been a Plat Note Vacation at Lot #1 two lots from us in 1983 for a garage with a 10’ setback in lieu of the platted 30’ setback. Most recently a block away in our subdivision two other lots had multiple setback changes to allow for a small narrow home on a newly subdivided lot. Across from that street a stand alone garage was added within the rear yard setback. For these reasons, we request modifying the platted rear yard setback to allow for the in-ground pool.
